Dark matter is a theory, and one based upon our need for an explanation why the universe doesn't act the way it does. As far as theories go, it ain't bad- its got a bit more weight than certain things, such as string theory...

Now of course, were there to discover the HIgg's bosn over in CERN in 2007 i'm sure we could learn a bit more bout dark mater.

Dark matter is a hypothesis that fits the phenomena we see, there has been no evidence to specifically support the existence of dark matter, therefore it is not a theory. There are other explanations that could be said to be equally valid.

The problem with dark matter is obviously that it's "dark", very much like space. The whole point of it is it's very large, heavy enough to distort space which gave people the ideas it existed in the first place, while still being not directly seeable. People have only really decided dark matter (whatever it's form) must exist because of fairly large inconsistancies they've seen in space with regards to the velocity of galaxies and their rotation vs the gravational energy present to hold the same galaxies together (both the galaxies themselves, and the clusters they make up). From what I've read, either the theories of gravity are wrong with numbers that big, or there's something providing extra gravity in the galaxies and clusters, which people have named "dark matter". This doesn't mean to say that people agree on what dark matter actually is; only that it might be the answer.
Anyway, as the "dark matter" has no evidence disproving it, but there's evidence that it's basic description (can't be seen and has [large] mass) fits, surely it can be called a theory? Many places talking about it do describe it so.

Edit: neglected to mention dark energy as another alternative
