I like the way the BBC makes this point

here is a nice little bit of dry humour from the BBC, regarding criticism of China's controls over the internet:

I guess its the same about the "nobody has been arrested for posting their opinion on the internet". Did you know that its now common for search engines to be filtered/censored in germany?

A german federal state is issuing orders for ISPs to supress certain internet sites for 2 or 3 years now. So far the courts have usually backed those orders up. Recent law changes in germany made it pretty impossible to find out which internet sites are blocked/filtered while in the past an adult could (after quite some hassle) get a list of those adresses. Now that nobody can verify whats blocked anymore, the range suddenly seems to increase a lot - for example a US site about body modifications (piercing, tattoos) is now beeing filtered/supressed in german search engines. All due to "protection of the youth" and recently the EU has mentioned that youth protection on the internet has to be increased and pointed at germany as a good example of how it should be done.

Yes i can very much understand the viewpoint of china.

Well they arent getting arrested for posting their opinion on the internet, are they. Theyre getting arrested for being involved in actions trying to overthrow the government. Theres a significant difference between expressing an opinion, and committing a speech act deliberately designed to incite violence. For example, if I say "I hate black people" then this should be protected under free speech, but thats different from saying "I hate Mr Smith the black man, could someone go kill him please, his address is 32 Guilmont Drive, London".

Not that this distinction matters much here since I assume that starting pro-nazi websites or denying the holocaust online is illegal in Germany.

You think its stating your opinion and the government sees it as incitement of the people or something equally weak defined like Article 301 of the Turkish penal code or §166 of the german StGB.

Thats something different because the second case is seen as participation in planning or incitement of a crime. Saying "I hate black people" is just as long an opinion till somebody thinks you are stirring up racial trouble in germany. What was a "sniper" in 1997 or an activist freeing animals, can nowadays be declared a terrorist (both happened in the US).

Several of these things are very borderline though - i remember the legal discussions arising from a webpage listing medical doctors who participate in legal abortions in the US. With photo, adress, workingplace and as much additional info as possible...
