Who is the sympathetic one here?
There is a case in my office at the current time which has nothing to do with me but which is somewhat entertaining.
There are two neighbors. Mr. P and Ms. T. Mr. P does not like Ms. T in the slightest. Ms. T is not fond of Mr. P though perhaps not without good reason. Recently Ms. T decided to water her back yard and puposely or inadvertantly sprayed some water into Mr. P's yard. Mr. P who complains that Ms. T waters her yard in such a fashion as to undermine the soil along the fenceline separating their respective backyards. Mr. P also complains that in the past Ms. T has thrown dirt and other foreign matter over his fence and into his pool. Mr. P is a middle aged man who cannot walk and is confined to a wheel chair. Ms. T is a transexual female. She has successfully turned from a caterpillar into a butterfly. On the day in question, Mr. P decided to retaliate on the watering front by wheeling himself into the backyard, hooking up his hose and shooting water through a knot hole in the fence wetting down Ms. T's patio in the process. Ms. T noticed this happening and became quite upset by this behavior. (I indicated she had become a woman, I did not indicate that she had become a particularly stable woman) Quick thinking Ms. T grabbed her camcorder and got several minutes of footage on Mr. P spraying her yard with water via the know hole in the fence. This will be exhibit A at the trial. After filming the tresspass Ms. T stepped out into the backyard and began to yell at Mr. P to stop doing this. Eventually Mr. P did stop wattering through the fence. Mr. P then beckoned Ms. T to come over to the fence where they could converse more-or-less face-to-face. Ms. T was willing to converse so she walked over to the fence where she placed her eye to the knot hole so as to be able to see Mr. P in his wheel chair. Mr. P responded by pepper spraying Ms. T in the eye through the knot hole. When the police arrived, at Ms. T's urging, they took statements from both parties. Mr. P, while admitting that he had pepper sprayed Ms. T through the fence, told police that he felt threatened in that Ms. T threatened to poison his plants. A simple case of plant defense. Just to make things more pleasant, Mr. P, throughout his entire statement to the police referred to Ms. T exclusive as "it". When this goes to trial (and I would bet that it will) I will be surprised if the jury doesn't rise up en masse and pummel both individuals. |

As Mr. T has no evidence of the alleged misdemeanours surely the Jury wont be able to pummel Ms. P? In this instance I'd like to see Dante's legalised revenge idea tested: you'd get a transvestite pepper spraying a wheelchair bound gentleman. That's just not cricket, is it?

This seems to be the sort of case that cries out for one of the Judge Judy-type shows. Don't you have some sort of mechanism to alert the media when you have one of these waste-of-taxpayer's-money/bizarre-enough-for-reality-tv cases?
If you don't have such a mechanism then maybe they pay a finder's fee? ;) |

Tactitus is right. You could collect a share of the profits which would certainly offset if not cover the wasted money. Time to revolutionise the DA's office, DDA.

I'm confused why people are implying theyre both to blame, it seems like a fairly one-sided case and the Mr. P guy should get hammered for it

How can you say that? His plants had been directly threatened by an ungodly transformer. It should consider itself lucky he used the minimum of force to protect his precious Petunias.

Well I would have almost agreed with Nodrog, but I think any wheelchair bound man spraying a tranny via a knothole in the fence deserves special recognition.

A case clearly that should have gone to arbitration before all of the pepper spray and threats incident occured.
But, pepper spray is assualt, yelling at your neighbour isnt, so that would be why its now in a court of law, not sat behind a table in a quiet room sorting it out point by point and making agreements on both sides asthey go along. Neither of them were behaving rationally, they were behaving emotionally and in the end the sad thing is that the guy in the wheelchair took it much too far. And is the criminal in this case. |

Shouting is almost always irrational in that it very rarely achieves the desired result. If anything it makes people less co-operative.

From what's been stated by dda there's no proof of misbehaviour by Ms T*. Mr P has addmitted he broke the law. I'm surpised that Mr P's lawyer's haven't asked him to plea-bargin 'cause that's what always seems to happen on American "justice" TV shows.
*he hasn't mentioned if witnesses have sworn that they heard Ms T screaming at the top of her lungs admitting past wrongs (throwing items into Mr P's garden) and threatening him / his property. |

Having sorted though all of the thoughts in this thread, I quite like the idea of putting it on Judge Judy, however, I think that a Judge Lester show sounds better yet. That way I could gather a greater portion of the revenue generated by the pain of others. It would be the capitalist thing to do.
