High And Dry
 
Well I'm kind of pissed off. Not as pissed off as other people, but still pretty pissed off.

My friend had 2 Radiohead tickets off his parents for his birthday.

One was for me! \o/

Another friend then bought a ticket. As did my girlfirend.

The concert is tomorrow. There are no tickets.

The company has gone into liquidation, so I doubt there will be any tickets.

I'm going to get them to send their info to try and get a refund but it probably won't happen and is little comfortanyway. Although £45 is always aslight comfort.

Anyway, annoyed.

What is more perculiar is that this website is dated March 19, 2008. Therefore, all tickets were bought on-line AFTER the company had gone into liquidation. How was this possible?

I've had a quick look at that link. The Official Receiver has been appointed so it is probably likely that the company is in a Compulsory Wind up (Liquidation)

In a compulsory liquidation, commencement of the liquidation is retrospective to the date the petition was presented. In this case even if the winding up order was later, the company will have deemed to commence liquidation at the date of the presentation. I'm assuming that was the 5th )although i haven't checked) as the provisional liquidator was appointed then. The provisional liquidator will have to act with the interests of the creditors in mind (usually he is just there to protect the company's assets and do anything else the court orders).

If you are correct in that you ordered the tickets after the liquidation commenced, then you should be able to make a valid claim against the liquidation.

The OR will most likely appoint an Insolvency Practitioner to take on the liquidation and once that happens you will find yourself in a better position to make that claim (or find out why it happened and if you're entitled to compensation).

Dispositions of company's assets post presentation of winding up order are void in a compuslory liquidation so the OR or any subsequent liquidator will be holding those assets on behalf of people like you.

If you're lucky that company might just end up at my firm as (without looking at the accounts) it's the type of company we like to liquidate. If that is the case... i'll do my best to help you from there.

As a follow up ASG - did you book your tickets with a Credit Card (note CREDIT not DEBIT). If so you should be able to claim the money back from your credit card company

Out of the 4 people going, I didn't actually pay for a ticket, so I'll look into that.

In the end, I was sitting at work and I heard the sound check and I decided that I absolutly had to go. So I looked around and found 2 tickets on Gumtree from someone just down the road (he literally ran to give me the tickets :up:). Exactly the same price as buying them on the website.

I started out with a free ticket and ended up paying for two.* My mate who didn't go is a MASSIVE Radiohead fan and I'm not sure if I should tell him we went.
